Tamil Nadu Muslim Munnetra Kazhagam mark Babri demolition anniversary with protests

Tamil Nadu Muslim Munnetra Kazhagam organised protests and demonstrations throughout the state on Friday, December 6, marking the Babri Masjid demolition. The party raised three main demands: a review of the unconstitutional judgement delivered in the Babri Masjid case, expeditious punishment for the persons responsible for the demolition of Babri Masjid and protection of places of worship of minorities.
Defying the ban order by the state police, thousands of men and women participated in the demonstration and courted arrest. In Chennai, Prof. M.H. Jawahirullah, President of TMMK led the protest. G. Ramakrishnan. Politburo member, CPI (M); Sinthanai Selvan, General Secretary, Viduthalai Siruthaigal Party; Velmurugan, President, Tamilzhaga Valurimai Katchi; Viduthalai Rajendran, General Secretary, Dravidar Viduthalai Kazhagam and Inigo Iruthayaraj of Christian Goodwill Movement of fraternal parties addressed the demonstration.
Prof. M.H. Jawahirullah said the November 9 judgement on the land dispute of 464-year-old Babri Masjid has been criticised by several legal luminaries and former Judges of the Supreme Court as outright denial of Justice.
He pointed out that Hon’ble A.K. Ganguly, former Judge of the Supreme Court observed that the Muslims have witnessed the existence of a mosque on that site for several generations which has been demolished and a temple is going to be raised on the same site as per the judgement of the Supreme Court, which has raised several doubts in my mind. As a student of Constitutional law, it is very difficult for me to accept the Judgement, Ganguly had said.
Jawahirullah pointed out that another former Supreme Court Judge Markandeya Katju condemned the judgement by observing that “the saddest day after the Partition of the country was the day when the Babri Masjid was demolished. The Supreme Court Judgement while declaring the act of demolition as illegal has however in the final part of the judgement contradicted itself by allowing the construction of Ram temple in the same site.”
Jawahirullah said the Supreme Court accepted all the following stand of the Muslim litigants:
• Babri Masjid has not been constructed after demolishing a Ram temple.
• The Muslims possess documents to prove that Namaz (Islamic Worship) has been offered in the Babri Mosque from 1856 to 1949.
• The Idols were illegally smuggled into the mosque on the night of December 22 and the early hours of December 23, 1949.
• The demolition of the Babri Masjid on December 6, 1992, is “an egregious violation of the rule of law”
“The Supreme Court while accepting all the above-mentioned points stated that the Muslims were unable to prove that the mosque after its construction in 1528 was used for offering Namaz up to 1857…it chose to decide the entire dispute on one factor: that Muslims were unable to show evidence of exclusive possession of the site between 1528 and 1857 because there was evidence of Hindu worship in the outer courtyard. Hence, the court granted the entire land for temple construction which is both unconstitutional and a denial of Justice. Against this background, we are holding a demonstration,” Jawahirullah added.
